What are the options for businesses seeking foreign workers?
Businesses in California that are seeking foreign workers have many options available to them. One option is to sponsor a foreign national to get an H-1B visa, which is a temporary work visa that allows the foreign national to work in the U.S. for up to six years. The sponsoring business must prove to the U.S. Citizenship and Immigration Services that the foreign worker has the necessary qualifications and experience to do the job. Another option is to get a green card for the worker, which allows the foreign national to live and work in the U.S. permanently. To obtain a green card, the business must first get a labor certification from the Department of Labor. This certifies that there is a shortage of qualified U.S. workers to do the job and that a foreign worker is needed. In addition, businesses can sponsor foreign nationals for certain other visas, such as an E-2 Investor Visa or a TN Visa, which is for certain Canadian and Mexican professionals. To get one of these visas, the business must show that the foreign worker has the requisite qualifications and experience and that the business can financially support the worker. Finally, businesses can hire foreign workers who are already in the U.S. on a student visa or another type of visa. These foreign nationals can work for the business while they are in the U.S., as long as they follow the rules of their visa. However, businesses should be aware that not all visas allow foreign nationals to work in the U.S.
