What are the restrictions on employing foreign students?

In Mississippi, foreign students are subject to the same immigration law restrictions as all other non-citizens. Generally speaking, it is illegal for employers to hire foreign students without obtaining authorization from USCIS (U.S. Citizenship and Immigration Services). The following restrictions apply to any business that wishes to hire foreign students in Mississippi: 1. Proof of identity. All employers must request and keep a copy of a foreign student’s valid passport and visa, or expected passport and visa, before hiring them. 2. Proof of authorization. All employers must also obtain written authorization from USCIS to hire foreign students. They must submit an I-129 petition to USCIS on behalf of the student detailing their eligibility, and must receive approval from USCIS before hiring the student. 3. Maintenance of records. All employers must maintain a record of the foreign student’s authorization documents, including their visa, passport, and USCIS-issued authorization forms. These must be kept up-to-date for as long as the student is employed. 4. Compliance with terms. Employers are required to comply with the terms of the student’s authorization forms. This includes such requirements as providing the student with timely salary payments, meeting their educational requirements, and complying with labor laws. Failure to abide by these restrictions may result in serious consequences for employers. In addition, foreign students who are found to be in violation of the terms of their visas may be subject to removal from the U.S., or may be subject to other forms of penalties. It is important for employers to understand and comply with all immigration law restrictions when hiring foreign students in Mississippi.
