What is the process for extending a non-immigrant status?
In order to extend a non-immigrant status in Illinois, an individual must submit a Form I-539 to United States Citizenship and Immigration Services (USCIS). This form is used to apply for a change in a non-immigrant status. The individual must include the following documents when submitting the Form I-539: • Evidence that the individual has not violated any terms of their non-immigrant status. • Evidence of the reasons that the status needs to be extended, such as a job offer from a sponsoring employer. • Evidence that the individual is able to support themselves financially during the requested period of stay. • A valid passport • A completed Application for Employment Authorization Document (if needed) • A completed Supplement A (if applicable). If the individual is applying as the dependent of a primary applicant, they must also submit evidence of the primary applicant’s status. Additionally, the individual may need to submit additional documents depending on their particular circumstances. After reviewing the application and supporting documents, USCIS may issue a Temporary I-551 stamp, also known as a “bridge” to extend the individual’s non-immigrant status. If the extension of the non-immigrant status is approved, the individual may receive a new Form I-94 indicating the new expiration date. In some cases, USCIS may also require the individual to attend an interview. The purpose of the interview is to verify information on the application, and the individual must bring additional documents and information to the interview.
