What is required for a child to adjust their status?

In order for a child in Virginia to adjust their status and become a citizen or legal permanent resident, they must meet the requirements of the Immigration and Nationality Act (INA). First, the child must have been admitted to the United States as a nonimmigrant (a temporary visitor) or as an immigrant. Additionally, the child must have been inspected by an immigration officer and have obtained a visa at a port of entry. Second, the child must meet the eligibility requirements for the applicable immigration category. These requirements vary depending on the category. For example, if they are applying for a green card based on family sponsorship, they must demonstrate that they have a qualifying relationship to a U.S. citizen or permanent resident. Third, the child must demonstrate that they have been an individual of good moral character. The child must have not been convicted of certain crimes, must have paid any taxes due, and must have not abused any public assistance programs. Finally, the child must pay all applicable fees, complete the necessary forms, and submit them to the U.S. Citizenship and Immigration Services (USCIS). The USCIS will then review the application and either approve or deny the request for adjustment of status. Once approved, the child will be able to become a citizen or legal permanent resident.
