Can a child apply for DACA (Deferred Action for Childhood Arrivals)?
Yes, a child in Washington State may apply for DACA (Deferred Action for Childhood Arrivals). DACA is a type of deferred action from the U.S. federal government that provides temporary protection from deportation and access to a Social Security number and work authorization for certain immigrants who were brought to the U.S. as children. In order to apply for DACA, the individual must be under the age of 31 as of June 15, 2012, and must have been present in the United States since June 15, 2007. The individual must also be enrolled in school, have graduated from high school, have obtained a GED, or have been honorably discharged from the military. In addition, the individual must have not been convicted of a felony, a significant misdemeanor, or three or more other misdemeanors and cannot pose a threat to national security or public safety. Individuals who are granted DACA are eligible to receive valid employment authorization documents (EADs). However, DACA does not provide a path to citizenship or lawful permanent resident status. Furthermore, DACA does not provide protections for any family members of the eligible individual.
