Are children able to receive an Employment Authorization Document (EAD) if they are in removal proceedings?
In Alaska, it depends on the age of the child and the type of removal proceedings. Generally, employment authorization is only available to those in removal proceedings who are either over the age of 14 or are under the age of 14 but are already the principal beneficiary of an immigrant visa petition. However, if a child is under the age of 14 and is not the principal beneficiary of an immigrant visa petition, then they are not eligible for an Employment Authorization Document (EAD). In addition, a child in removal proceedings must have been admitted to the United States under a non-immigrant visa in order to be eligible for an EAD. Furthermore, it is the discretion of the local USCIS office whether they will grant an EAD to the child. The child must be seen by the USCIS officer so that the child’s credibility can be assessed. When it comes to deciding whether or not to grant an EAD to a child, the USCIS will consider the child’s age, the type of removal proceedings they are in, and whether or not the child has been admitted to the United States under a non-immigrant visa. Ultimately, it is up to the discretion of the local USCIS office to decide whether or not to grant an EAD.
