What is deportation?

Deportation is the process of expelling an individual from the United States to their home country or a third country. In Louisiana, deportation is a complex process that involves a great deal of paperwork and legal proceedings. The majority of deportation cases in Louisiana are initiated by the Department of Homeland Security. In some cases, individuals may be deported because they have overstayed their visa, or because they have committed a serious crime that requires their removal from the country. Unless the individual is a U.S. citizen or holds certain form of legal status, they can be removed from the U.S. The deportation process begins with the Department of Homeland Security issuing an arrest warrant for the individual. This warrant is then used to take the individual into custody, and they are transported to a detention center. Following detention, the individual is given the opportunity to make their case and apply for a stay of removal. This is where an immigration lawyer can be of great assistance, as they can help determine the best course of action and help the individual present their case. If the individual’s stay of removal is denied, they are then sent to their home country. Depending on the situation, the individual may have a chance to return to the U.S. at a later time. If this is not possible, they will have to stay in their home country permanently.
