What is mandatory departure?

Mandatory departure is when foreign nationals are required to leave the United States without a hearing or appeal. In South Carolina, mandatory departure is primarily used for aliens who entered the United States without inspection, such as those who crossed the border without going through a port of entry. Aliens who enter the country without inspection can be subject to Mandatory Departure, meaning they are not eligible for a hearing or appeal in the immigration court. Mandatory Departure can also be used in cases where an alien has committed serious immigration violations such as overstaying a visa, being caught working in the US without authorization, or committing a crime that renders them ineligible for an immigration status. In such cases, the affected person is not entitled to a hearing before a judge and can be given a mandatory departure order. If an alien receives a mandatory departure order, they will need to leave the United States within a specific amount of time. If they fail to comply with the order, they can be subject to criminal charges such as re-entry after deportation. Once an alien has been issued a Mandatory Departure order, they will not be eligible for most forms of relief, such as asylum or cancellation of removal. They will also be subject to a three to ten year reentry ban, depending on the circumstances. This ban will apply to all forms of traveling, including re-entry to the United States, applying for visas, and applying for green cards.
