What is an Administrative Removal Order?
An Administrative Removal Order (ARO) is a deportation order issued by the Department of Homeland Security (DHS) or Immigration and Customs Enforcement (ICE) in New York. AROs are issued when someone is not legally authorized to be in the United States, such as if their visa has expired or if they have violated immigration laws. An ARO requires the individual to leave the country within thirty days or face deportation. An ARO may be issued to an individual who has been arrested by federal or state authorities or who has been determined to be inadmissible to the United States. Individuals who receive an ARO are typically not allowed to remain in the United States for any length of time, and they must depart as soon as possible. AROs may also be issued to individuals who have overstayed their visa or who have otherwise violated U.S. immigration laws. In addition to being issued an ARO, individuals who are subject to deportation may also be placed in removal proceedings, which involves a process where they can defend their case and potentially remain in the United States. In some cases, removal proceedings may be waived, and the individual may instead be issued an ARO. Ultimately, an ARO is issued to individuals who are not legally authorized to be in the United States and who must leave the country within thirty days after receiving the order. If the individual does not comply with the ARO, they may be subject to deportation.
