What is the “one-year bar”?
The "one-year bar" is a restriction put in place by U.S. immigration law, which prevents some foreign nationals who have been living in the United States unlawfully from returning to the U.S. for a period of one year. This applies to people who have either been “deported” (removed from the U.S.) or “voluntarily departed” (left the U.S. when given the option of either remaining in the U.S. or leaving the country). The “one-year bar” also applies to people who have been in the U.S. without legal status for more than 180 consecutive days, and then left the country. This is called “unlawful presence” in the U.S. and those affected by this restriction are usually not eligible to re-enter the U.S. until a period of one year has passed from the date of their departure from the U.S. The “one-year bar” applies to people who have been living in or traveling to the U.S. without a valid visa, as well as to those who have overstayed their visas or otherwise violated the terms of their visa. It is important to note that the “one-year bar” does not necessarily mean a full year must pass before re-entry is possible. Depending on the circumstances, some exceptions may apply.
