What is a Judicial Removal Order?
A Judicial Removal Order, also known as a Deportation Order, is a legal order issued by a court of law in the United States. It requires an immigrant who has been convicted of a criminal offense to be removed from the United States. In California, a removal order may be issued if an immigrant is convicted of a felony or a deportable offense. Felony offenses that may lead to a removal order include serious crimes like murder, rape, and aggravated assault. Deportable offenses include immigration-related offenses such as illegal entry, failure to register for immigration status, and immigration fraud. A removal order can only be issued by an immigration judge in a court proceeding. The judge will look at the facts in the case to determine if the immigrant has committed a deportable offense or if there are aggravating factors that would make a removal order appropriate. The judge must also consider if the immigrant is a danger to the community or poses a flight risk. Once a judge has issued a removal order, the immigrant must be processed by the Immigration and Customs Enforcement (ICE). ICE arranges for the immigrant to be removed from the United States and returned to their home country. Judicial Removal Orders are an important tool in California’s immigration law system. By removing those who have committed serious crimes, it helps to maintain the public’s safety and security. It also ensures that immigrants who are in the country illegally are removed and sent back to their home country.
