What is a Judicial Removal Order?
A Judicial Removal Order, commonly referred to as a deportation order, is a legal document issued by a judge in U.S. immigration court when an individual is found to have violated an immigration law. The document specifies that the individual must leave the United States by a certain date and cannot return without special permission. The deportation order will include the reasons for the removal, a deadline for the individual to leave the country, and any other applicable instructions. The process for obtaining a Judicial Removal Order begins when the Department of Homeland Security (DHS) issues a Notice to Appear (NTA) to the individual who has violated an immigration law. The NTA will state the charges against the individual, and will order them to appear in court. If the individual does not appear in court on the scheduled day, or if the judge determines that the individual has violated an immigration law, the judge will issue a Judicial Removal Order. In Washington, the order will specify where the person must leave to and how long the individual has to leave the country. In some cases, the judge may also issue an order for the person to be removed from the U.S. immediately and to never return.
