What is an Asylum Application?

An Asylum Application is a legal petition that someone files with the U.S. government to request protection from deportation. In order to be eligible for asylum, an individual must prove that they have suffered persecution or fear of persecution in their home country due to race, religion, nationality, political opinion, or their membership in a particular social group. In Washington, an Asylum Application must be filed within one year of the applicant’s arrival to the United States. The individual must also be physically present in the U.S. when filing the application and cannot have left the country after arriving. In some cases, an individual may be granted an exception to the one-year deadline and allowed to file their application after the one year period. The application is typically reviewed by an immigration officer and usually consists of evidence of persecution and a detailed explanation of why the individual is seeking asylum. The application can also include supporting documents such as police records, medical records, witness affidavits, or any other evidence that supports their story of persecution. If the application is approved, then the individual is allowed to remain in the United States and receive certain benefits such as work authorization and protection from deportation. If the application is denied, then the individual will be subject to deportation and must leave the United States within a given timeframe.
