What is an immigration detainer?

An immigration detainer is a tool that U.S. Immigration and Customs Enforcement (ICE) uses to hold immigrants who may be subject to deportation in Washington. It is a written notice that requests that another law enforcement agency detain an individual for up to 48 hours beyond the time when they would have been released from custody in order for ICE to take custody of the individual and begin their removal proceedings. When a local law enforcement agency such as a police department receives a detainer from ICE, the officer must ensure that the individual is kept in custody for the additional 48 hours and is given notice of the detainer. During this period, ICE may investigate the individual and decide if they will try to deport them or not. Immigration detainers are a controversial method of immigration enforcement. Furthermore, they argue that these detainers result in people being jailed that have not been convicted of any crime and in some cases prevent citizens from receiving benefits they are entitled to.
