What is a Voluntary Departure Agreement?
A Voluntary Deportation Agreement is a legally-binding document that is signed by an individual who is facing deportation proceedings in the state of Washington. This agreement allows the person facing deportation to leave the United States voluntarily instead of going through the lengthy process of a deportation hearing. This agreement will also allow the individual to return to the United States at a later date, once the circumstances that resulted in deportation have been resolved. When signing a Voluntary Deportation Agreement, the individual must meet certain requirements such as providing proof of financial and travel arrangements, posting a bond to ensure their departure, and signing an Affidavit of Voluntary Departure. The individual must also agree to leave the United States within a designated period of time, typically 30 to 90 days. While signing this agreement may be beneficial in some cases, it is important to understand that a Voluntary Deportation Agreement is still considered a form of deportation and has the same long-term consequences. After signing the agreement, the individual will still be considered an “arriving alien” and must obtain a visa to re-enter the United States. In addition, the individual will be inadmissible to the United States for three or ten years depending on the circumstances.
