How can I appeal a deportation order?
If you have received an order of deportation, you may appeal the decision with the Board of Immigration Appeals (BIA). The BIA is an administrative body that is part of the United States Citizenship and Immigration Services (USCIS). The BIA, located in Falls Church, Virginia, reviews appeals of deportation orders. In order to appeal a deportation order in Pennsylvania, an immigrant must first submit a Notice of Appeal with the BIA. The Notice of Appeal should include information about your case, including the date of the immigration judge’s decision and a copy of the judge’s order. You will also need to provide any evidence or documentation that supports your appeal, as well as any additional documents that are required by the BIA. The BIA will review your Notice of Appeal, and then either hear your case in person or make a decision based on the documents you submitted. If you are appealing the deportation order in person, the BIA will schedule a hearing which you must attend. At the hearing, both you and the government will have an opportunity to present evidence, and you may be allowed to testify in your own defense. After the hearing, the BIA will make a decision on your appeal. If they decide that the deportation order should be overturned or modified, they will issue a decision.
