What is an Adjustment of Status?
An Adjustment of Status is a way to obtain lawful permanent residence, or a Green Card, in the United States by already being present in the country. This applies to individuals who fall under immigration laws that allow them to apply for a Green Card without having to leave the U.S. It is a legal process that can be used for certain individuals living in California who are facing deportation. It can be used by those who are in the U.S. legally, with a valid visa, or who have entered the country without inspection. Those in the U.S. on a temporary visa, such as a student visa, might also be able to apply for Adjustment of Status. To be eligible for an Adjustment of Status, an individual must be eligible for one of the immigration categories that allows for the Adjustment of Status application to be considered. These categories are: family-based immigration, employment-based immigration, refugee/asylum status, and certain special immigrants. Each of these categories has specific requirements that must be met in order to qualify. Once approved, the applicant will be able to remain in the U.S. on a permanent basis and eventually become a U.S. citizen.
