What is a Voluntary Departure?

Voluntary Departure is a type of departure from the United States available to some individuals facing deportation from California. This option is available to those who have been issued a Notice to Appear (NTA) by the Department of Homeland Security and face removal from the country. Unlike other types of deportations, voluntary departure allows the individual to leave the United States on their own volition, typically within a set time frame. When a person chooses to voluntarily depart the US, they waive their right to a removal hearing, and the Department of Homeland Security (DHS) agrees not to pursue criminal charges. The individual is typically notified of the process in a disclosure document and given a specific date by which they must depart the US in order to avoid legal consequences. This option is not available to everyone facing deportation. Generally, those who are eligible for voluntary departure must not have a criminal record and must not have participated in any activities that would make them ineligible for deportation. Individuals who receive a grant of voluntary departure must also provide evidence of ability to fund their return trip and are responsible for their own travel arrangements. Overall, voluntary departure is a form of deportation that offers an alternative to individuals who do not want to risk the possibility of harsher deportation proceedings, as well as those who want to avoid the financial burden and stress that comes along with those proceedings. It’s important to note, however, that those who choose to voluntarily leave the US may face difficulties if they attempt to re-enter.
