What is a Motion to Reopen or Reconsider?
A Motion to Reopen or Reconsider is a motion filed with the United States Immigration Court by a person subject to deportation proceedings seeking relief from removal. The motion allows the individual to argue for their case to the court by presenting evidence and facts that could help them win a favorable ruling. In California, filing a motion to reopen or reconsider proceedings is often referred to as a “MTR.” An MTR is considered an opportunity for an individual to present new facts or evidence to the court that could potentially prove that their removal is not justified. This is an essential tool for people who want to fight their deportation, as it can be their last chance to argue their case in order to remain in the United States. In order to file an MTR, the individual’s immigration proceedings must have already been concluded. Additionally, the individual must present valid evidence that can be used to argue in their favor. This evidence can include documents, affidavits, and testimony from credible witnesses. The evidence must be new and not previously considered by the original judge handling the case. When an MTR is filed, the court will determine whether or not to reopen the proceedings. If the court grants the motion, then the individual may be allowed to present their case again or be given a new hearing. If the motion is denied, the original ruling remains in effect. It is important to note that MTRs are not guaranteed to be approved, so individuals should ensure their evidence is strong and relevant.
