What is a Notice of Intent to Deny?

A Notice of Intent to Deny (NOID) is a formal notice issued by U.S. Citizenship and Immigration Services (USCIS) that informs the applicant that their application for a particular benefit may be denied. This notice contains a statement of the reasons why the application may be denied, and it gives the applicant the opportunity to provide evidence or additional information that will help clarify their application. In California, NOIDs are mainly issued for immigration cases, primarily in relation to deportation proceedings. A NOID can be issued for a variety of reasons, including a lack of evidence supporting the claim, failure to meet eligibility requirements, or for fraudulent misrepresentation. A NOID may also be issued if USCIS suspects that the applicant is seeking to obtain a benefit to which they are not entitled. The notice usually gives the applicant 30 days to respond, either with a written or oral response. If the applicant is able to successfully address the reasons in the NOID, the application process will continue, and the case may be approved. If the applicant is not able to provide adequate answers, then the application will likely be denied, and the applicant may be subject to deportation proceedings. In California, it is important to note that once a NOID has been issued, the applicant has a limited amount of time to provide evidence or additional information to clarify the application. Failure to do so may result in the application being denied and the applicant being subject to deportation proceedings.
