What is a “Motion to Stay Deportation”?

A Motion to Stay Deportation is a request filed with the United States government to prevent the deportation of an individual from the United States. The motion is made by the individual facing deportation or their legal counsel, and is typically filed when the individual has a strong case for remaining in the United States. The motion seeks to stay the deportation proceedings, stopping the government from initiating removal until a determination can be made. In California, an individual facing deportation is strongly encouraged to seek counsel and discuss their options. If deportation through removal proceedings is imminent, the individual or their counsel may file a Motion to Stay Deportation with the court, the United States Citizenship and Immigration Service, or the Board of Immigration Appeals. If the motion is successful, the deportation order is delayed and the individual can remain in the United States while their case is considered further. The judge will consider a number of factors when deciding whether to stay the deportation. Factors such as the length of time the individual has been in the United States, family ties the individual has in the United States, the strength of their claim for remaining in the United States, and immigration history will all be taken into consideration. The judge will also consider any potential threats to the public or safety issues when making their decision. If the motion is denied, the individual may still be able to stay in the United States through the use of other relief such as a waiver or cessation.
