What is an immigration detainer?

An immigration detainer, or ‘hold’, is a tool used by Immigration and Customs Enforcement (ICE) to take custody of foreign nationals for removal purposes. When an immigration detainer is issued, it orders law enforcement agencies to hold an immigrant in their custody until ICE arrives to take the individual into their custody. A detainer is issued based on a person’s immigration status and criminal history. ICE has authority to issue detainers based on information obtained through criminal or immigration databases. For example, if a person has a criminal record or has already been ordered to leave the United States, ICE may issue a detainer for that person. In California, immigration detainers are often used to ensure that immigrants with pending removal orders appear before a court to determine their immigration status. Detainers can also be placed on immigrants who have been arrested for certain crimes. This is done to ensure that the individual will be deported after they serve their sentence. It is important to remember that a detainer does not guarantee the individual will be deported. It merely ensures that they will be held to answer for removal proceedings. In addition, an immigration detainer is generally only in effect for 48 hours. After that, the local law enforcement agency is no longer required to comply with its terms.
