What is an Arrest Warrant?

An arrest warrant is a legal document issued by a judge or other authorized government official that orders the arrest of a person suspected of committing a crime. In the state of New York, an arrest warrant can be issued for a variety of reasons, including failure to comply with immigration law or deportation orders. When an arrest warrant is issued, it allows law enforcement officers to take into custody anyone accused of a crime. This could include law enforcement officers from the Immigration and Customs Enforcement agency (ICE) or local police officers. Typically, arrest warrants will specify details of the crime and the individual (or individuals) being sought. In the case of immigration law violations or deportation orders, a judge may issue an arrest warrant for anyone who has avoided complying with these laws or orders. Once an arrest warrant is issued, law enforcement officers in New York can take that individual into custody. This can mean detaining them in a local jail or transferring them directly to an ICE facility. Once in custody, an individual can appear before a judge and enter a plea, or may be subject to deportation proceedings.
