What is a “reasonable fear” interview?

A reasonable fear interview is a process immigrants go through to have a chance to remain living in the United States. This interview involves a one-on-one question and answer session in which an immigration officer determines if the immigrant has a reasonable fear of returning to their home country. In New York, a reasonable fear interview is conducted in front of an immigration judge or designated asylum official who will evaluate the credibility of the immigrant’s fear of persecution in their home country. The interview is also used to determine the individual’s eligibility to receive asylum in the United States. During the interview, the immigration officer will ask questions about the applicant’s identity, reasons for fleeing their home country, and any potential proof of the fear of persecution. This proof may include documentation from other countries, medical records, witness statements, and other supporting evidence. If the immigration officer determines that the individual has a valid fear of persecution, they will be allowed to remain in the U.S. and the interview will be closed. If the officer determines that the immigrant’s fear is not credible, the immigrant will be deported to their home country. The reasonable fear interview can be a difficult and intimidating process. To prepare for this interview, it is important to consult with an experienced immigration lawyer who can advise you on the evidence you will need to present and the questions you will likely be asked. This can help you feel more prepared and confident during the interview.
