What is an Order of Supervision?

An Order of Supervision (OS) is a legal document issued by the United States Immigration and Customs Enforcement (ICE) to an immigrant who is in the deportation process in New York. An Order of Supervision is a form of relief that allows an individual to stay in the country while awaiting an immigration hearing. An OS provides an immigrant with the ability to remain in the U.S. while allowing them to work, obtain government benefits and services, and travel, although foreign travel will be restricted. The Order of Supervision also requires the individual to report to an ICE office regularly. It is important to remember that an OS does not guarantee that an immigrant can remain in the U.S. but simply allows them to remain while the immigration process is completed. In most cases, an OS will be issued to an immigrant as an alternative to detention if they are released from custody while awaiting their hearing. It is important to note that receiving an Order of Supervision does not guarantee that the individual will be allowed to remain in the U.S. and an immigration judge will make a final decision based on the immigrant’s case.
