What is a Notice of Intent to Deny?

A Notice of Intent to Deny (NOID) is a document issued by the US Citizenship and Immigration Services (USCIS) which informs the person or organization of their intention to deny an application they have filed for an immigration visa or other benefit. This document is usually sent to the petitioner when there is some discrepancy or error in the application or if the application does not meet the required criteria for the benefit sought. When a NOID is sent, the petitioner has the right to submit a response to the notice, which will be considered before a final decision is made. In the case of New York immigration law, a NOID is sent out by the USCIS to inform a foreign national or other individual who has applied for a visa, asylum, or other immigration benefit that their application is going to be denied due to some irregularities with the documents or if the applicant has failed to meet the required standards. The NOID also informs the individual of the reasons why their application is being denied and provides them with the opportunity to respond and correct any errors. The response from the individual or organization must be received within 30 days of the receipt of the notice in order to be considered. Once the response is received, the USCIS will review the new information and decide whether or not to approve the application. The issuance of a NOID is a potential problem for applicants who are hoping to gain entry into New York. Therefore, it is important to read the NOID thoroughly and respond within the time frame given so that the application can be properly considered.
