What is an immigration detainer?

An immigration detainer is a document issued by U.S. Immigration and Customs Enforcement (ICE) to hold an immigrant in custody while they are investigated for possible deportation. Detainers are used when ICE is investigating immigration violations, such as those who have entered the country unlawfully, or those who have committed a crime. When a detainer is issued, the subject of the detainer is held in a detention center while ICE decides if the individual is eligible for removal from the United States. The detainer is also used as a notification to the local jail or prison holding the individual that they should not release the detainee until they can be taken into ICE custody. Detainers are used as part of the deportation process in New York and throughout the United States. They are an effective way of ensuring individuals who have engaged in criminal activity or who are ineligible to remain in the United States are taken into custody and removed from the country.
