What is a stay of removal?

A stay of removal is a legal order that directs the Immigration and Customs Enforcement (ICE) agency to temporarily stop removal proceedings against a non-citizen. A stay of removal is a common form of relief that allows an immigrant to remain in the United States despite a prior removal order or pending deportation. A stay of removal is issued by a judge or immigration court and requires ICE to cease any attempts to remove the immigrant from the United States. It can be issued for a variety of reasons, such as to allow an individual to appeal a removal order, or to protect an immigrant from harm. In order to qualify for a stay of removal, an immigrant must meet certain criteria. This includes providing evidence of hardship, such as financial or medical hardship, or evidence of a family relationship to a U.S. citizen. Applicants must also demonstrate that they will not pose a danger to the public and must prove that they are not a flight risk. In New York, a stay of removal can be requested by filing a motion to stay in the Immigration Court. The motion must include evidence that the immigrant is eligible for the relief and has presented a valid claim for relief. ICE can also agree to a stay if it determines that such relief is warranted. If a court grants the motion to stay, ICE must cease all attempts to remove the immigrant until the stay is lifted or a final order of removal is issued. A stay of removal is not a permanent resolution and the immigrant may still be subject to removal proceedings in the future.
