What is a Notice of Intent to Deport?

A Notice of Intent to Deport (NOID) is a document issued by U.S. Immigration and Customs Enforcement (ICE) that informs a person that they are subject to deportation from the state of New Hampshire. The NOID is a warning that a person can be deported from the U.S. and includes their name and description, details of why they are being removed from the country, and their rights during the deportation process. The NOID is issued when a person is suspected of violating U.S. immigration law, and a deportation decision has been made. It is typically served to the person in person, or it may be sent via registration mail. If the person receives the NOID, they are required to appear before an immigration judge. The person subject to deportation has the right to present evidence to the judge in order to contest or delay the deportation. If the judge finds the person deportable, he/she will then issue a Final Order of Deportation. However, if the deportation is postponed, the person may be able to remain in the state of New Hampshire and continue to live in the United States while the case is pending. It is important that any person who has received a Notice of Intent to Deport seek legal advice from an experienced immigration lawyer as soon as possible. The attorney can explain the deportation process and help the person contest the deportation or seek any other available relief.
