What is a Motion to Reconsider?

A Motion to Reconsider is a legal action that can be taken when an individual has been deported from the United States. It is a request to the issuing court or agency to review the decision made in a previous case and change it. This motion is typically used if an immigrant believes that they were wrongfully deported or that they have new evidence that could help their case. In South Carolina, a Motion to Reconsider may be filed in the local Immigration Court. To file such a motion, the immigrant must provide a detailed explanation as to why they should be allowed to stay in the United States. The immigrant must also provide appropriate evidence demonstrating why they are eligible to remain. If granted, the judge may reopen the case and consider the immigrant’s claims anew.
