What is a Notice of Intent to Deny?
A Notice of Intent to Deny (NOID) is an official document issued by U.S. Citizenship and Immigration Services (USCIS) that informs an applicant for immigration benefits that their application is likely to be denied. This document is sent to an applicant when USCIS has identified grounds for denial of the application. In the state of South Carolina, a NOID can be issued when USCIS has received information indicating that an applicant may not be eligible for immigration benefits. An applicant who receives a NOID has the option to refute the grounds for denial in their application before any final decision is made. In some cases, a NOID may include new evidence or information not previously provided by the applicant. If the applicant does not present a convincing argument in response to the NOID, their application may be denied. The USCIS will typically provide the applicant up to 30 days to respond to the NOID and provide supporting evidence. If an applicant’s immigration application is denied, it is likely that they will be subjected to deportation proceedings.
