What is an immigration detainer?

An immigration detainer is a tool used by U.S. Immigration and Customs Enforcement (ICE) to detain a person who is suspected of being in the country illegally. Detainers are issued when a person is arrested by state or local law enforcement. The detainer directs the law enforcement agency to hold the person for up to 48 hours after their release from state or local custody, so that ICE can take them into federal custody for possible removal from the United States. In Texas, ICE can issue detainers for a variety of immigration offenses. This can include crossing the border illegally, overstaying a visa, failing to register with the government, or participating in criminal activities. Texas law enforcement agencies are required to comply with detainers issued by ICE, though they are not required to conduct any investigations or take any other action in order to detain someone for ICE. Detainers are one of the primary tools used by ICE to carry out the deportation process in Texas. Under immigration law, a person being held under an immigration detainer can be removed from the United States without a formal deportation proceeding. This is done in order to speed up the process and reduce the number of removal proceedings that need to be handled.
