What is a “reasonable fear” interview?
A “reasonable fear” interview is an immigration law process designed to help foreign individuals who might qualify for certain forms of relief from deportation or removal from the United States. The individual will generally have a one-on-one interview with an United States Citizen and Immigration Services (USCIS) official. During this interview, the individual must establish to the USCIS official that they have a “reasonable fear” of persecution or torture if they were removed from the United States. These claims are judged based on the individual’s country of origin or nationality, political opinion, race, religion, and/or social group. In Louisiana, this reasonable fear evaluation is also known as a “credible fear” assessment. The individual must provide evidence to support their claim that they have a reasonable fear of persecution or torture if they returned to their country of origin. The USCIS officer will evaluate the evidence and make a determination as to whether or not the individual has sufficient credible fear to warrant further consideration for deferred action or other relief from deportation or removal. This determination is made on a case-by-case basis. An individual who is found to have a valid reasonable fear will be allowed to stay in the United States temporarily, and may be eligible to apply for a more permanent form of relief from deportation or removal.
