What is a voluntary surrender of removal?

A voluntary surrender of removal (VSR) is a process that occurs when an immigrant in Louisiana is subject to deportation, but instead of going through the removal proceedings, they surrender themselves to the U.S. Department of Homeland Security and agree to removal from the country. A VSR allows an immigrant to leave the United States on their own terms, and avoid the lengthy and costly legal process of removal proceedings. In order to complete a VSR, the individual must be issued a Notice to Appear from the U.S. Immigration and Customs Enforcement (ICE) and must show proof of their identity. They must agree to leave the country within 90 days, and are required to sign a voluntary departure agreement. The individual is then eligible to request a Voluntary Return, in which they may remain in the United States for up to 30 days in order to make arrangements for leaving the country. It is important to note that a VSR is not an automatic process, and it must be approved by an immigration judge. If approved, the individual will be allowed to leave the United States under their own terms and conditions. The voluntary surrender of removal is an option for those who may not qualify for other forms of relief and who need to leave the country due to immigration violations.
