What is labor certification?
Labor certification is a process that is required by the US Citizenship and Immigration Services (USCIS) in order for an employer in Florida to hire a foreign worker. It is used to ensure that the wages and working conditions of the foreign worker being hired are not detrimental to the wages and working conditions of US workers. The first step of the labor certification process is for the employer to file an Application for Permanent Employment Certification (Form ETA-9089) with the US Department of Labor. This application must include information about the job position, including the wages, benefits, and working conditions. The employer must also demonstrate efforts to recruit US workers for the position. If the application is approved, the employer must then obtain labor certification from the USCIS. To do this, the employer must prove that there are not enough US workers capable of performing the job, or that hiring the foreign worker will not cause significant displacement of US workers. The employer must submit evidence of recruitment efforts and evidence of the wages, benefits, and working conditions that the foreign worker will receive. If the USCIS approves certification, the employer can then start the process to apply for an employment-based visa for the foreign worker. Labor certification is an important part of the immigration process and is necessary for employers to legally hire foreign workers in Florida. The process requires substantial effort on the part of employers to meet the requirements set forth by the US government.
