What is the EB-3 visa?
The EB-3 visa is an employment-based visa that allows foreign nationals to work and live in the United States on a permanent basis. This visa is available to three different categories of workers: (1) highly skilled workers, (2) professionals, and (3) unskilled or other workers. All applicants must have a job offer from a U.S. employer and must meet certain criteria to be eligible. In Florida, the employer must also prove that the applicant is not displacing a U.S. citizen or legal permanent resident. Highly-skilled workers with a college degree or higher and a minimum of five years of job experience may qualify for the first preference category of the EB-3 visa. The second preference category is for members of the professions who hold a U.S. bachelor’s degree or its equivalent. Unskilled workers must have two years of experience in their field and a job offer from a U.S. employer to qualify for this third preference category. The applicant will need to submit documentation that proves their eligibility. This includes a labor certification, proof of education or experience, the appropriate petition form, and other evidence of their qualifications. The application process for the EB-3 visa in Florida can take several months or even years, depending on the visa category and how long the Department of Labor takes to process the labor certification.
