What is the H-1B visa?

The H-1B visa is a type of employment-based, non-immigrant visa that allows foreign-born workers to work in the United States. This visa is also known as the “Specialty Occupation” visa, as it is usually given to people who possess at least a bachelor’s degree or equivalent qualifications in a specialty occupation. In Florida, the H-1B visa is used to fill full-time positions that require a specific set of skills that are not available in the local labor market. In order to obtain an H-1B visa, an employer must complete and submit a Labor Condition Application (LCA), which certifies that the employer will pay the prevailing wage for that occupation in the geographic area in which the employee will be employed. The employer must also demonstrate that the employee will have the same benefits and working conditions as any other employee in the same job position. Additionally, the employer must obtain a “Certificate of Labor” that verifies the employee’s education, experience, and credentials are equivalent to those of the employees in the U.S. The H-1B visa allows foreign-born workers to legally work in the United States for up to six years. During that time, the employee can apply for an extension of his/her visa. The current Florida law requires employers with more than 25 full-time employees to offer H-1B visas to qualified foreign-born employees. Although the H-1B visa has some of the most stringent requirements of any employment-based visa, it is an important tool for employers in Florida that are hiring foreign-born workers in specialty occupations. This type of visa helps employers fill positions in professions such as technology, medicine, engineering, and other specialized fields.
