What is the H-1B visa?

The H-1B visa is a type of visa used for temporary employment of foreign workers in the United States. It is specially designed for workers in specialty occupations, which may include positions in the fields of architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, law, accounting, business specialties, and the arts. Anyone wanting to work in Texas under the H-1B visa must first obtain a labor certification from the United States Department of Labor. This includes proving that the employee is either qualified for the job, or that the job is not suitable for a US worker. Once the labor certification is approved, the employer will then need to apply for a visa from the United States Citizenship and Immigration Services (USCIS). In order to remain employed in Texas on the H-1B visa, workers must continue to meet the qualifications of their job and must have the required documentation such as passport, visa, and employment eligibility certification. Once the visa expires, workers will need to apply for an extension. The length of the extension will depend on the type of job they are in and the labor market in the area. The H-1B visa allows Texas employers to access to a larger pool of highly skilled workers, while also allowing foreign workers the opportunity to gain experience and education in the U.S. It is a beneficial program for both employers and employees, and has been an important part of immigration law in Texas.
