What is a national interest waiver?

A national interest waiver is a type of employment-based immigration law waiver that enables certain foreign nationals to bypass the sponsor requirement for permanent residence. This type of waiver is available for those individuals whose presence in the U.S. is deemed to be in the national interest of the country. Under Illinois law, the U.S. Citizenship and Immigration Services (USCIS) may grant a national interest waiver to foreign nationals if: • The foreign national is working on a project of substantial merit and national importance; • His or her admission is in the national interest; • The foreign national has extraordinary abilities and is capable of making noteworthy contributions to the United States; or • The foreign national has an outstanding record of achievement in their field that will benefit the United States. A foreign national who is granted a national interest waiver should first submit a petition for permanent residence to the USCIS. The petition must explain how the individual will benefit the United States through his or her presence. If the USCIS approves the petition, the foreign national will be granted permanent residence status without needing a sponsor. In some cases, an employer may submit a petition for a national interest waiver on behalf of an employee if they can demonstrate that the employee’s presence is beneficial to the United States.
