What is the H-2B visa?
The H-2B visa is a type of non-immigrant employment visa available to foreign nationals who are coming to the United States to work in a certain type of job. It is commonly used in fields like construction, hospitality, manufacturing, landscaping, and forestry. It is generally issued for temporary or seasonal jobs and can be used to fill temporary labor gaps. In Texas, the H-2B visa is usually issued for positions that do not exceed a one year period. The employer in Texas requesting to hire an H-2B visa holder must be able to prove that the specific job cannot be filled by a U.S. worker; they must also demonstrate that the foreign worker will not have a negative impact on the wages and working conditions of similarly employed U.S. workers. Furthermore, the employer must also offer the foreign worker the same benefits as those provided to U.S. workers. Once a potential foreign worker is approved, they will be given an I-94 Form, which serves as proof that they are allowed to stay and work in the United States. The H-2B visa is unique in that it is the only type of employment visa that can be issued after the foreign worker has already arrived in the country. In general, the H-2B visa is an invaluable tool for employers in Texas who need to fill temporary positions for which they cannot find qualified U.S. workers. It provides an avenue for legal foreign work and can be beneficial to both the employer and the foreign worker.
