What is the H-3 trainee visa?
The H-3 trainee visa is a type of legal visa offered to foreign nationals who wish to come to the United States for job-related training for a period of up to two years. The purpose of the H-3 trainee visa is to provide foreign nationals with the opportunity to gain experience and to receive instruction in skills that are not available in their own countries. In Arizona, anyone who wishes to receive an H-3 trainee visa must first apply for it through the U.S. Citizenship and Immigration Services (USCIS). In order to be eligible for an H-3 trainee visa, a trainee must be coming to the United States for the purpose of receiving training in a field that is not available in their own country. Additionally, the training must not be available through an accredited American educational institution. The training must also be provided by an employer, or by a person or organization that has expertise in the specialty sought by the trainee. Once an H-3 trainee visa is approved, the individual will be allowed to stay in the United States for a period of up to two years to receive the training. During this time, they will be required to abide by the laws of the United States. They should also be able to obtain employment while they are in the United States, although this may be subject to restrictions. In Arizona, employment of foreign nationals with an H-3 trainee visa may be restricted, depending on the individual’s visa status. It is important for those employed with an H-3 trainee visa to understand the conditions of their visa and to abide by any and all regulations. Employers should also be aware of the potential restrictions on employing foreign nationals with an H-3 trainee visa.
