What is an I-485 Adjustment of Status application?

An I-485 Adjustment of Status application is an application filed with the United States Citizenship and Immigration Services (USCIS) that allows certain immigrants to change their nonimmigrant status to immigrant status, or from one immigrant status to another. This type of application is commonly used by immigrants who wish to apply for a Green Card, or legal permanent resident status in the United States. In Florida, an I-485 Adjustment of Status application is usually used by immigrants who have a family member or employer that is sponsoring them. The sponsorship limits the type of work the immigrant can do in the US, and requires the immigrant to follow certain rules set by the government. The immigrant must have a valid visa or other form of legal status prior to filing the application. During the application process, the immigrant must provide evidence proving that they are eligible to work in the US. This includes a valid I-94 arrival and departure form, proof of employment, and evidence that the immigrant is not in the country illegally. If approved, the I-485 Adjustment of Status application will allow the immigrant to work in the US legally. Immigration Law – Employment in Florida will also protect the immigrant from exploitation in the workplace. Employers are not allowed to discriminate against immigrants, and must adhere to the same laws as a US citizen when hiring an immigrant worker.
