What is an L-1B visa?
An L-1B visa is a type of visa issued under US immigration law for foreign nationals who are coming to work in the US in a “specialized knowledge” capacity. This type of visa allows employers in Arizona to transfer an employee from a company abroad to work in the same company in the US. The employee must have been employed for at least one year in the three years prior to entering the US and must have specialized knowledge about the company’s products, services, research, equipment, techniques, management, or other interests. The visa holder must demonstrate that the specialized knowledge gained from their overseas employment can help the US company. In terms of the length of stay in Arizona, the visa holder can stay for up to five years, although the visa may be extended in certain situations. The visa holder’s spouse and unmarried children under the age of 21 may be admitted into Arizona on an L-2 visa, and they can apply for a work permit. It is important to note that the L-1B visa is only available to those who are employed by a qualifying business, such as a parent, branch, affiliate, or subsidiary of the foreign company. Additionally, the visa limits the stay of L-1B holders to the period of time necessary to accomplish the purpose of the stay. Therefore, the visa holder must establish that they will leave the US after the visa expires.
