What are the requirements for an H-1B visa?

To receive an H-1B visa in New York, an individual must have a job that requires a specialized set of skills that cannot be filled domestically. For example, physicians, computer programmers, and engineers typically must have this type of visa. Additionally, the employer must be willing to pay the beneficiary of the visa a wage that is the same or higher than the prevailing wage of that occupation in the New York labor area. The beneficiary must also have obtained a college degree in their field of expertise. The employer must submit a Labor Condition Application (LCA) to the U.S. Department of Labor, which includes the job title, the terms and conditions of the job, and the wage offered. Once the LCA is approved, the employer can then complete the H-1B Visa application, along with the required documents, such as a copy of the degree, a letter of employment, and evidence of the beneficiary’s ability to perform the job. Once the visa is approved, it is valid for three years and can be renewed for an additional three years. However, the individual must remain in the same position for each three-year period that the visa is renewed. If the beneficiary wishes to change employers, they must apply for a new H-1B Visa. In general, the H-1B visa holder must remain in the US for a minimum of six years. Additionally, the H-1B visa requires the beneficiary to pay taxes and abide by US laws and regulations. Failure to do so can lead to the visa being revoked.
