What is the E-2 visa?

The E-2 visa is a type of visa that allows a person from a particular foreign country to come to Texas (or any other U.S. state) to invest in and operate a business. This type of visa is available only to people from countries that have an existing treaty of commerce and navigation with the United States. The E-2 visa holder must be coming to the United States solely to engage in business activities at a “real and active” commercial or entrepreneurial undertaking. This type of visa also allows certain employees of qualifying businesses to enter the United States in order to perform the executive, managerial, or essential roles of the company. In order to receive an E-2 visa, an applicant must provide evidence that they are investing substantial capital in the business and are in possession of a substantial portion of the business’s resources. An individual with an E-2 visa is eligible to remain in the United States for up to two years at a time. They can also renew their visa as long as the underlying investment continues and the business meets the requirements of the treaty. The visa holder is authorized to work for only the qualifying business and can bring family members with them, provided those family members also meet the requirements of the visa.
