What is the H-1B visa?
The H-1B visa is a type of employment-based, non-immigrant visa that is used to temporarily allow foreign workers to legally work in the United States, including the state of Texas. This visa is usually used for workers with highly specialized knowledge, such as in fields like engineering, mathematics, science, and technology. In order to obtain an H-1B visa, the applicant must usually have a job offer from a U.S. employer. That employer must also obtain approval from the U.S. Department of Labor, and they must also prove that the applicant has the particular set of skills or knowledge that is needed for the job. The H-1B visa can last up to three years, though it can be extended for an additional three years. In Texas, there are specific regulations that employers must follow in order to hire a foreign worker with an H-1B visa. Any foreign national working in Texas must be employed for as long as their visa is valid, and they must also receive the same wages and benefits as U.S. citizens. Additionally, foreign nationals may be asked to provide proof of their employment status.
