What is an ICE detention?

An ICE detention is the process of an individual being taken into custody by Immigration and Customs Enforcement (ICE). This typically occurs when an individual is suspected of being in the United States illegally or if an individual has violated a condition of their visa. In Massachusetts, an ICE detention generally occurs in one of two ways. The first is at the federal level, where ICE agents work with federal, state, and local law enforcement to locate and apprehend people they believe are in the country illegally or who have violated terms of their visas. These operations are often carried out in public spaces or homes, and those taken into custody can be transported to ICE detention centers for processing. The second type of ICE detention occurs at the state level. Under Massachusetts state law, ICE agents are permitted to enter private homes unannounced if they believe someone is living in the state illegally or if they have violated a condition of their visa. Individuals apprehended in this way are detained until they can be taken to an ICE detention center. ICE detention is a serious matter, and individuals subject to it can find themselves facing deportation or other punishment. Those looking to ensure their legal status in the U.S. or who have questions regarding their visas should seek the advice of an experienced immigration attorney in order to understand their rights and to prevent ICE detention.
