What is the process for applying for a U visa?

In Massachusetts, applying for a U visa is a legal process that helps immigrants who are victims of certain crimes. To qualify for a U visa, the applicant must have been the victim of a qualifying crime, must have suffered substantial physical or mental abuse as a result of the crime, must have helped in the investigation or prosecution of the crime, and must be of good moral character. The process of applying for a U visa in Massachusetts begins with filing Form I-918, the Petition for U Nonimmigrant status, with U.S. Citizenship and Immigration Services (USCIS). This form should include a description of the qualifying criminal activity, evidence of the applicant’s involvement in the investigation or prosecution, and proof of physical or mental harm resulting from the crime. Once the application is received, the National Visa Center (NVC) will contact the applicant to provide document requirements and processing fees. After the documents are provided and the fees are paid, USCIS will evaluate the application and may require additional evidence. If approved, the applicant will be contacted by the NVC to schedule an interview at the Embassy or the U.S. Consulate. At the interview, the applicant will be asked to present additional documents and will be required to answer various questions. If approved, the applicant may receive their U visa within 1-3 months. After receiving the U visa, the applicant may apply for permanent residence and eventually seek U.S. citizenship.
