What is the process for applying for a T visa?
Before you can apply for a T visa, you must first qualify. To be eligible, you must have suffered trafficking, be currently in the United States, be willing to cooperate with law enforcement in their investigations of traffickers, and demonstrate extreme hardship if you were to be removed from the United States. The Trafficking Victims Protection Act (TVPA) of 2000 provides various protections for trafficking victims and those who have been a victim of a severe form of trafficking in persons. Once you have determined that you qualify for a T visa, the next step is to fill out and submit the appropriate application. This includes Form I-914, Application for T Nonimmigrant Status, and its related forms, including the Supplement A, Supplement B (if applicable), and Supplement C. You must also submit evidence to support your claim of extreme hardship. The supporting documents you must submit include evidence of severe trafficking, proof that you are currently in the United States, proof that you will cooperate with law enforcement, and evidence supporting your claim of extreme hardship. This may include medical evidence, affidavits, or other convincing written documents. Finally, you must provide proof of your identity and nationality, such as your birth certificate, passport, or other identification. Once you have submitted all the paperwork and supporting documents, the U.S. Citizenship and Immigration Services (USCIS) will review your application and make a determination on your eligibility for a T visa.
