What is an immigration bond?

An immigration bond is a type of bond that can be posted in order to allow an immigrant who has been detained by the Immigration and Customs Enforcement (ICE) to be released from custody until their court hearing. In Washington, immigrants may be granted an immigration bond if they can prove that they are not a flight risk and that they will show up for their hearing. The amount of the bond is determined by a judge and can range from a few hundred dollars to thousands of dollars. Immigration bonds are different from criminal bonds, which are typically posted after the accused has been convicted. Immigration bonds are posted prior to the hearing, in order to get the immigrant released from detention before their court date. The immigrant is then allowed to remain in the community while they are awaiting their court hearing. If the immigrant fails to appear in court, the bond amount is forfeited to ICE. In Washington, an immigration bond can be posted either by the immigrant, their family, or a third-party surety. In some cases a bond may be waived if the immigrant can demonstrate their good faith in showing up for their scheduled hearings. It is important to remember that in Washington, the decision of whether to grant an immigration bond is ultimately up to the judge.
